01Who you are contracting with
This website and every service offered through it are provided by FOREVER WORKS S.R.L. (trading as Forever Works), a Romanian limited liability company registered under J08/2983/2021 with tax identification number 45079498, having its registered office in Brașov, Romania. In these terms, "we", "us" and "Forever Works" mean that company, and "you" means the person or organisation using the website or engaging our services.
02What these terms cover
They govern your use of www.foreverworks.com and everything published on it. By using the site you accept them. If you do not, please stop using the site.
They do not, by themselves, create a service relationship. Professional services are always governed by a separate written agreement signed by both parties, and where that agreement conflicts with these terms, the agreement wins.
03Using the website
You may read, quote and link to this site freely, including for professional purposes. What you may not do is:
- use it in a way that breaks the law, infringes anyone's rights, or is designed to deceive;
- attempt to gain unauthorised access to it, or to any system or network connected to it, except as expressly allowed by our disclosure policy;
- interfere with its operation, including through automated traffic that degrades service for others;
- scrape or reproduce it at scale to build a competing offering, or to train a commercial model, without our written permission;
- remove or obscure any notice of ownership or authorship.
04Intellectual property
The site, its text, design, typography, code, the Forever Works name and logotype, and the case files published on /work are owned by us or used with permission, and are protected by copyright and trade mark law. Nothing on this site transfers any of those rights to you.
Short quotation with attribution and a link is welcome and needs no permission. Anything more, including republication, translation or commercial reuse, needs our written consent.
Rights in work we deliver under a client engagement are dealt with in that engagement's contract, not here. Our standard position is that the client owns the deliverables, and that everything ships in the client's own repository from the first day.
05What the site is, and is not
The content here describes what we do and what we have built. It is published in good faith and kept current, but it is general information rather than professional advice, and it is not an offer capable of acceptance. Nothing on this site creates an obligation on us to provide services, quote a price, or accept an engagement.
The case files describe real systems in production. Clients are deliberately anonymised and identifying detail is withheld under confidentiality obligations, so the descriptions are accurate in substance while omitting names, systems and figures we are not free to publish.
06Booking a call
The scheduler on /book reserves a conversation, nothing more. It costs nothing, commits neither side to anything, and either side may cancel or reschedule. The scheduler is operated for us by Google; what happens to the data you enter is described in our Privacy Policy.
07How an engagement is agreed
Work begins only when scope, price, timing and responsibilities are set out in writing and signed by both parties, whether as a services agreement, a statement of work, or an accepted written offer. That document also carries the terms this site deliberately does not attempt to fix in advance: payment terms, acceptance, warranties, term and termination, data processing, and any limitation of liability specific to the engagement.
08Confidentiality
Information you share with us while exploring a possible engagement is treated as confidential and used only to evaluate and prepare it. We do not need your confidential material to have a first conversation, and we would rather you sent less of it than more until an agreement is in place.
09Third-party links and services
Some pages link to, or embed, services operated by others, such as the scheduling tool and our LinkedIn page. We choose them carefully but do not control them, and we are not responsible for their content, availability or practices. Their own terms and privacy notices apply when you use them.
10Availability and liability
We work to keep the site available, accurate and safe, but we publish it "as is". We do not warrant uninterrupted availability, freedom from errors, or fitness for a particular purpose, and we may change, suspend or withdraw any part of it at any time.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill arising from your use of this site, or from reliance on anything published on it. Liability arising from a signed engagement is governed by that engagement's contract.
Nothing in these terms limits liability that cannot be limited under Romanian law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for intentional misconduct or gross negligence.
11Governing law and disputes
These terms, and any dispute arising out of them or out of your use of this site, are governed by Romanian law. The courts competent for the registered office of FOREVER WORKS S.R.L., in Brașov, Romania, have exclusive jurisdiction, except where mandatory consumer protection rules give a consumer the right to bring proceedings elsewhere.
We contract with businesses. If you nevertheless deal with us as a consumer, your statutory rights are unaffected by anything written here, and the routes for resolving a consumer dispute out of court are listed in the Legal Notice.
12Changes to these terms
We may update these terms as the business or the law changes. The current version is always the one published here, dated at the top of the page, and it applies to your use of the site from the moment it is published. Terms agreed in a signed contract can only be changed by agreement between the parties, never by an edit to this page.
